1. Acceptance of Terms

By accessing or using this website and client portal (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Service.

2. About the Service Provider

The Service is operated by Lijo Abraham, a Mortgage Agent Level 1 licensed by the Financial Services Regulatory Authority of Ontario (FSRA), licence #M26000806. All mortgage brokering activity is carried out on behalf of and under the supervision of Pegasus Mortgage Lending Center Inc., a licensed mortgage brokerage, FSRA Brokerage Licence #11479 (the "Brokerage"). All dealing or trading in mortgages described on this site is conducted through, and is the responsibility of, the Brokerage in accordance with the Mortgage Brokerages, Lenders and Administrators Act, 2006 (Ontario) (the "MBLAA") and its regulations.

You may verify either licence on FSRA's public registry at fsrao.ca.

3. Scope of a Mortgage Agent Level 1 Licence

A Mortgage Agent Level 1 may deal and trade in mortgages only with mortgage lenders that are listed in section 1 of O. Reg. 408/07 — principally banks, credit unions, caisses populaires, loan and trust corporations, insurance companies, and other prescribed financial institutions ("FRFIs"). A Mortgage Agent Level 1 is not authorized to deal or trade in mortgages with private investors or other non-listed lenders, and is not authorized to act for a mortgage administrator. Where your circumstances require a private mortgage, your file will be referred within the Brokerage to a Mortgage Agent Level 2 or Mortgage Broker who is licensed for that activity.

4. Not Financial, Legal or Tax Advice

Information, calculators, rate tables and educational content provided through the Service are for general informational purposes only. Posted rates are indicative, change without notice and are subject to lender approval, qualification, the stress test under Guideline B-20, mortgage default insurance rules and other terms and conditions. The Service does not constitute legal, tax, accounting or individualized financial advice. Always consult appropriately qualified professionals before acting.

5. Suitability, Disclosure & Conflicts of Interest

When recommending a mortgage product, the Brokerage and its agents are required to take reasonable steps to ensure the product is suitable for your needs and circumstances (O. Reg. 188/08 and O. Reg. 187/08). Before you sign a mortgage application or commitment, the Brokerage will provide written disclosure of:

  • The nature of our relationship with you and with the lender;
  • The number of lenders we deal with and the names of any lenders that represent more than 50% of mortgages arranged in the prior fiscal year;
  • All fees, compensation, rebates, bonuses or other remuneration we may receive in connection with your mortgage, and the basis on which they are calculated;
  • Material risks of the mortgage product being recommended; and
  • Any actual or potential conflicts of interest, including any direct or indirect interest in the property or in the transaction.

6. No Mortgage Commitment

Use of the Service, submission of a lead, completion of an online application, uploading of documents, or correspondence with the agent does not constitute an offer of credit, a pre-approval, a commitment to lend, or a guarantee that any lender will approve a mortgage. Any mortgage offer is made solely by the lender, in writing, and is subject to that lender's terms, conditions and approval process.

7. User Accounts

  • You must provide true, accurate and complete information;
  • You are responsible for maintaining the confidentiality of your password;
  • You must notify us immediately of any unauthorized access;
  • You accept responsibility for all activity carried out under your account.

Knowingly providing false or misleading information in a mortgage application is an offence under the MBLAA and may also constitute fraud under the Criminal Code of Canada.

8. Acceptable Use

  • Do not use the Service for any unlawful or fraudulent purpose;
  • Do not upload information about another individual unless you have authority to do so;
  • Do not attempt to gain unauthorized access to systems, accounts or other users' data;
  • Do not interfere with the operation of the Service, or upload malware or automated traffic.

9. Documents & Electronic Signatures

Documents you upload (e.g. T4s, NOAs, bank statements, agreements of purchase and sale, ID) are held in accordance with our Privacy Policy and the Brokerage's record-keeping obligations under O. Reg. 188/08 (minimum six-year retention). You consent to use of electronic documents and electronic signatures in accordance with the Electronic Commerce Act, 2000 (Ontario) and PIPEDA Part 2 for any application, consent or disclosure exchanged through the Service.

10. Intellectual Property

All content, design, trademarks and branding on the Service are the property of Lijo Abraham and/or Pegasus Mortgage Lending Center Inc. and their licensors. You may not reproduce, distribute, modify or create derivative works without our prior written permission, except for personal, non-commercial use of materials provided specifically to you in connection with your mortgage file.

11. Third-Party Links

The Service may link to lender websites, government resources or other third-party sites. We do not control and are not responsible for those sites or their content, privacy practices or terms of use.

12. Errors & Omissions Insurance

As required by the MBLAA, the Brokerage maintains errors and omissions insurance that includes coverage for losses resulting from fraudulent acts. This insurance is for the protection of consumers and is subject to its own limits, deductibles and exclusions.

13. Complaints & Dispute Resolution

If you have a concern about the service you received, please contact Lijo Abraham in the first instance. Unresolved complaints will be escalated to the Principal Broker of Pegasus Mortgage Lending Center Inc., who is responsible under the MBLAA for handling complaints in accordance with the Brokerage's written complaints policy. 14. Limitation of Liability

To the maximum extent permitted by law, and except for liability that cannot be excluded under consumer protection legislation, neither Lijo Abraham nor Pegasus Mortgage Lending Center Inc. shall be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law. Nothing in these Terms limits a brokerage's, broker's or agent's obligations under the MBLAA or its regulations.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how personal information is collected, used, disclosed and safeguarded under PIPEDA and the MBLAA.

16. Termination

We may suspend or terminate your access to the Service at any time, including for breach of these Terms or where required by law or by the Brokerage's compliance obligations. Sections relating to disclosure, intellectual property, limitation of liability, record retention and governing law survive termination.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
